HEALTH INFORMATION INQUIRIES

Policy

 

 

 

 Health information gained from a student must be kept confidential and used only in the direct interest of the student.

 

 

Procedure

 

 

 

 

A.      Student Health Services must report some of a patient’s medical information to state or federal legal authorities, such as law enforcement officials, court officials or government agencies as required by law.  For example, it may have to report abuse, neglect, domestic violence or certain physical injuries, or respond to a court order.  If information is released, the information released and to whom it is released will be documented in the patient medical record.

B.      Student Health Services may release a patient’s medical information in response to a court or administrative order, subpoena or discovery request, but only if it has first given the patient notice of the order, subpoena or discovery request and an opportunity to quash it.

C.      Student Health Services may be required to release medical information to state/federal authorities to help prevent or control disease, injury or disability.  This may include using the medical record to report certain diseases, injuries, birth or death information, information of concern to the Food and Drug Administration.

D.      Any Student Health Services inquiries regarding campus health concerns from reporters or the media, will initially be discussed with the Associate Vice-President and Vice of Student Affairs and the Worcester State University, Public Relations Department.   Responses to these inquiries will be based on the recommendations of the Vice-President of Student Affairs and the WSU Public Relations Office.
